well i live in Indiana and the law here is if it is your house than you can remove asbestos. But i think the law is if the asbestos can not become friable (dust that can be inhaled) you may be able to just throw it away in the regular trash. But it would be good to look in your phone book for asbestos abatement company just to talk about regulations. You may ask them about how to remove it safely.

Disposal of the asbestos must be in a permitted landfill per Federal regulation (waste must be deposited in a placarded container lined with poly sheeting).
As far as removal, I believe that NY requires abatement of such a material by a licensed contractor. Essentially they are required to place dropcloths beneath the work and keep the material wet during removal. Though it seems very durable, during removal the shingles tend to break in pieces where they are nailed and you actually can release a fair quantity of asbestos fibers. So I would recommend removal by a contractor, though you could call the DEC to find out for sure whether “homeowner” removal is allowed in NY.
